1. Company Information
This website and all related services are owned and operated by DR SOLUTION.
2. Governing Law & Jurisdiction
These terms are governed by the provincial laws of Quebec and Ontario, alongside applicable federal laws of Canada.
- Legal disputes will be resolved in the courts of the province where the specific project took place.
- For Quebec clients, consumer rights under the Quebec Consumer Protection Act (CPA) apply and override any conflicting terms.
3. Deposit Requirements
DR SOLUTION requires a commitment deposit before scheduling any project.
- Payment: A 30% deposit is due upon signing the contract.
- Application: Deposits are applied directly to the final invoice of the specified project.
- Securing Dates: Work dates are not officially locked into our schedule until the 30% deposit is received.
- Material Allocation: This deposit is immediately used to allocate administrative resources and purchase project-specific materials and supplies.
4. Cancellation Policy
Cancellations impact our scheduling and resource allocation. The following terms apply:
- Client Cancellation: Clients must provide written notice of cancellation at least 5 business days before the scheduled start date.
- Late Cancellation & Material Costs: Cancellations made outside this window will result in the forfeiture of the 30% deposit. This deposit will be retained by DR SOLUTION to cover the costs of materials, supplies, and custom paint mixtures already purchased for the project, as well as lost booking time.
- Quebec Consumer Exception: In accordance with the Quebec CPA, if a contract is signed away from our main business place (e.g., at your home), Quebec clients retain a 10-day right of cancellation (cooling-off period) without penalty, during which any deposit must be refunded.
5. Paint Quality & Workmanship Warranty
DR SOLUTION stands behind its workmanship with a limited warranty.
- Coverage: We provide a 2-year limited warranty on workmanship, covering blistering, peeling, or chipping resulting directly from defective application.
- Exclusions: This warranty does not cover damage caused by structural settling, moisture intrusion, pre-existing substrate failure, ordinary wear and tear, fading due to sun exposure, or customer abuse.
- Manufacturer Warranty: Paint material warranties are provided directly by the paint manufacturer and are subject to their specific terms.
6. Intellectual Property
All content on this website is the property of DR SOLUTION.
- This includes text, graphics, logos, images, and digital downloads.
- You may not copy or reuse content without written permission.
7. Service Estimates and Pricing
Any pricing or project estimates provided are subject to change.
- Written quotes are valid only for the period stated on the document.
- Final costs may vary based on actual site conditions and project scope revisions.
8. Limitation of Liability
DR SOLUTION is not liable for indirect, incidental, or consequential damages.
- We are not responsible for pre-existing structural or surface defects.
- Our liability is strictly limited to the total amount paid for our services.
